Case Name and Roles White v. Samsung Electronics America, Inc., 971 F.2d 1395 Plaintiff/Appellant: Vanna White Defendant/Appellee: Samsung Electronics America, Inc. Procedural Background The district court stated that there was no use of a likeness and therefore there was not a violation of the right to publicity or right to privacy. They granted summary judgment against White on each of her claims. Facts Vanna White is suing Samsung Electronics because of an ad that contains a robot that resembles Vanna White. The robot is standing in front of a board that is almost exactly like the board from “Wheel of Fortune” that Vanna White has been on for years. Vanna White gave no consent and received no monetary gain from the advertisement. Deutsch advertising made the ads for Samsung. The ad showed Samsung VCRs being used in the future and Vanna White still being on wheel of fortune but replaced by a robot. The commercial was supposed to be comical.
