Procedural Backgrounds The bench trial decided to throw out the appellants claim stating that “Here’s Johnny” did not meet the likelihood of confusion test and did not violate Carson’s right to privacy. The court additionally stated that “Here’s Johnny” did not violate the right of privacy or public theories because these rights are only extend to a name or likeness and “Here’s Johnny” did not qualify. Facts Johnny Carson has been introduced for years on his show that the Defendant knows about by the phrase “Here’s Johnny.” Johnny Carson does not like that this phrase is being used as a slogan for a portable toilet company and is not receiving any financial benefit by having his catch phrase used. Carson’s company Apparel gave permission to Marcy Laborites (who makes toiletries) to use the phrase “Here’s Johnny.” “Here’s Johnny” has
