Medical Ethics 9-21-09 The essence of the article by George annes is that the Nebraska law is unconstitutional because it wasn’t actually clear whether or not they were prohibiting late term abortions because they were killing the fetus or whether they were also prohibiting the vacuum extraction which also kills the fetus They didn’t make any provisions for late term abortions that protect the mother 3 rd trimester abortions are very rare There has been a subsequent Supreme Court opinion which says a law prohibiting 3 rd trimester abortions in New Hampshire, even though it doesn’t say anything about the health of the mother, is constitutional o The supreme court has flipped back and forth between the two Disabilities Robertson’s article talks about 2 different infants, those born with disabilities and severely pre-mature infants He mentions in the beginning that before 1970s questions on whether to withhold treatment for a severely handicapped child was rarely contested o if a baby was born with a severe handicap such as spina bifida o In the early 1970s there was articles written that said that if a baby was born with this severe of a handicap the doctors would withhold treatment if the parents wanted them to Sometimes they would even tell the parents that they thought it was best to withhold treatment In 1970 there was a baby born with down syndrome in Baltimore, Maryland and the parents would not give their informed consent for the surgery o It is not uncommon for infants with down syndrome to have a problem in their digestive system where there is a gap in their intestine Intestinal atresia- intestine is not connected Can be fixed by connecting the two parts together If you don’t close gap there is no way for body to digest food If you don’t do surgery the infant will die o The doctors said that they did not have the authority to treat the child

o It took about 2 weeks for the baby to die 1972 a baby was born in Indiana with down syndrome and an esophageal atreasia- gap in esophagus (Baby Doe case) o Doctor told the parents that infants with down syndrome have a terrible quality of life
