UNIT 3 LOCAL GOVERNMENT 1. Define and explain the significance of the following: a. Commissioners’ court Legislative body for county; handles budget, sets tax rates, oversees programs and redistricting. b. County clerk, Treasurer sheriff, Tax Assessor-Collector, County/District Attorney, Justice of the Peace, Constables, Central Appraisal District District attorney/criminal district attorney-elected official who prosecutes criminal cases. County attorney-elected officer serving as legal officer (provides advice and services) for county gov and serves as a criminal prosecutor. County clerk-keeps records for the county commissioners court and for county courts (real estate titles, marriage licenses and responsible for conducting county and state elections). Justice of the Peace, Constables-provide judicial and court services. Tax Assessor-Collector-registers voters, collecting local property taxes, registering automobiles, and collecting motor vehicle sales taxes and registration fees. DO NOT ASSESS PROPERTY VALUES (only collects taxes). Central appraisal district-assesses value of property. Sheriff-serves as chief law enforcement officer in the county operating in unincorporated areas of county and leaves law enforcement in the cities to municipal police departments. Hires deputies and provide public safety, warrants and civil papers, conduct criminal investigations, arrest offenders, and operate the county jail. Treasurer-money manager. County judge-499 Auditor-500 District clerks-500 c. General law city Cities with fewer than 5k residents, governed by a general state law rather than by a locally adopted charter (majority of the cities are this type). d. Home rule city 495 Local gov has right and authority to govern itself (315 cities) e. Annexation 509 Enlargement of a city’s corporate limits by incorporating surrounding territory into the city; not required to obtain the consent of anyone for annexation, though it must hold public hearings. f. ETJ – extra territorial jurisdiction 509 The area outside a city’s boundaries over which the city may exercise limited control up too 5 miles outside limits. g. Eminent domain Once incorporated, a city has broad powers within its city limits. It may exercise the power of eminent domain , the power to condemn
