Clinton: On Thursday, you called in sick to work after management declined your request for time off due to a personal affair made on Tuesday of the same week. The rules as per article XIII states that sick leave accumulated by the employee shall be used only for personal illness not covered by workers’ compensation. As you had already advised management of the personal time off, this lack of attendance is not considered a sick leave of absence. Therefore, the rules as they pertain to the labor agreement under the sick leave article do not apply. Given that you did not work the day immediately following the holiday, you are not eligible for holiday pay as it pertains to the labor agreement, Article XI. Also, since you are not entitled to the holiday pay, the two hours worked overtime on Tuesday’s graveyard shift will not be paid at holiday pay. The work week consists of forty hours per week for a five day week and the starting time
