 THE SUPREME COURT JUSTICES OF 2009 Definitions: PRECEDENT: a judicial ruling that serves as the basis in a subsequent case. P.432   STARE DECISIS: “let the decision stand” p.432 JUDICIAL RESTRAINT: A judicial philosophy whereby judges adhere closely to  statutes and precedents in reaching decisions. P.438 JUDICIAL ACTIVISM: A Judicial philosophy whereby judges interpret existing  laws and precedents loosely inserting their own values in court decisions. P.438 The Supreme Court Justices in 2009: John Roberts: Chief Justice   September 29, 2005–present Appointed by: George W. Bush Background: upper class family, captain of football team in high school, clerked for  Judge Henry Friendly (US court of appeals), Clerked for Chief Justice Rehnquist,  Hired by Ronald Regan for special assist to atty general, Deputy solicitor general  under George H.W. Bush. Views: Conservative, “Judicial Minimalist” according to Cass Sunstiein, law Prof. at  University of Chicago; Respects precedent; administrator; wants to see more cases  heard by court. (Oyez.org) John Paul Stevens: December 19, 1975–present Appointed By: Gerald Ford Background: Upper class family; served in the Navy; had the highest grades in the  history of Northwestern Law School; has seniority amongst the Robert’s court. Views: Liberal; voice of moderation; judicial restraint, unconventional; “wildcard”,  NOT an administrator; relies on the other judges for issues he can’t decide or figure  out. (Oyez.org)

Antonin Scalia: September 26, 1986–present Appointed By: Ronald Regan Background: Strong Italian and Roman Catholic heritage; has 9 children; had an  swift moving confirmation to his current seat Views: Conservative core, colorful decisions, NY Times quoted Scalia in  saying”(Scalia) Basically believes legislative history is fraudulent and Judges should  never consider it,” Favors National power; on the Death Penalty he’s neutral but  claims it isn’t immoral; uses stare decisis; can be rude and intimidating to people  arguing in front of the court. (Oyez.org) Ruth Bader Ginsburg:  August 10, 1993–present  Appointed By: Bill Clinton Background: Mother and sister died when very young; Mother died of cancer just  before her graduation; Jewish, went to Harvard where she was one of 9 women and  made the Harvard Law Review; Husband also a law scholar; he was diagnosed with  testicular cancer while she was at Harvard; moved to NYC where she finished grad  school at Colombia and became first woman on both the Colombia and Harvard Law  reviews; turned down by Justice Felix Frankfurter for clerk position; throughout the
