I. BSAD 3200 Legal Environment of Business. a. Professor Ryan Pace II. Introductory Chapter 1 (Thursday 7 January 2010 a. Introduction i. The function of law is to provide stability and predictability. ii. LAW = ENFORCEABLE RULES GOVERNING RELATIONSHIPS AND CONTRACTS. 1. Contract Law – Contract Governing, Marriage, divorce law. iii. Jurisprudence = Study of Law; and (how the law should be developed). 1. Root- Juris doctor – study of law. III. Section 1 (Schools of Jurisprudential Thought) a. A judge’s function is not to make law, but to interpret and apply the law. i. Congress/legislature write the law and president signs it! b. Natural Law school = Inherit in human Nature; can be discovered through use of intelligence and reason. i. People have this view of what law should be. ii. Right to own property (should be because you are alive and have the right to own property – the right to get married or have children not because of gov. c.
