Chapter One: “Success for All Students in the General Education Classroom” Education and Civil Rights : The text provides only basic information about how we have arrived at the current legal status in education for individuals with disability. More background is needed to truly understand how we have arrived at our current legal framework of rights for these individuals. Please see a basic summary of the legislation on p. 9 of the text, but the following additions should be included: a. It is important to understand the current laws that protect education rights of individuals within the broader framework of CIVIL RIGHTS LEGISLATION AND COURT DECISIONS. The civil rights movement in the United States has a history that dates to the 1800s. The part of the history that is most important for us in education is dated to 1954, the Brown versus the Board of Education Supreme Court decision. Up until 1954, all states had the right to maintain separate schools for individuals of color, specifically African American students. Even though this practice was most blatantly implemented in the South, the practice maintained in many Northern states. The Brown Family of Iowa agreed to be the litigants in a court case that moved its way up to the U.S. Supreme Court. The landmark decision that “Separate but equal” is not constitutional created huge outcries in this country. The Supreme Court stated that, by its very nature, if education is maintained separately for classes of students, it is by that very fact unequal. It is important to note that this case was instigated by and for parents and children. Parents were the moving force. b. Other legislation ensued in the 1960s and 1970s. In 1965, the War in Poverty was declared by the Johnson administration and the Head Start legislation was passed. The legislation entitled children from families in poverty to receive a preschool education embedded within a variety of services, including nutrition, dental and medical. c. In 1968 , as parents began to demand equality for their children with disabilities, the HCEEAA act (P.L. 90-538) was passed. This was the first legislation to deal exclusively with education of handicapped children. It only provided funds to stimulate and improve upon programs already in place in individual districts, and it initiated development of model programs for infants, preschoolers and parents. There was no mandate built into this legislation. It was entirely optional
