The quitclaim deed is not as sturdy as the warranty deed, it quit simply “conveys an interest that the grantor had.” It is not as concrete. It provides the least amount of protection and is weak when compared to the warranty deed which Linda possesses. The warranty deed is more precise and establishes who truly holds a title. 2.) Juan is right to sue for breach of the lease agreement and for damages, His covenant of quiet enjoyment was breached. “The covenant forms the essence of the landlord tenant relationship, and if it is breached, the tenant can terminate the lease and sue for damages. With this being understood, Juan did nothing wrong and should be compensated for his damages. 4.) Unless Frank signed away his rights to the home to Sarah then I believe that he should be the person held responsible for the damages.
