Chapter 1 S TUDY Q UESTIONS 1) If justice is defined as the fair, impartial consideration of opposing interests, are law and justice the same thing? No. I believe that justice is possible because of the law. The law consists of the rules that are enforced in order for justice to be achieved. 2) What is jurisprudence? Jurisprudence is the philosophy of the law. (a) Which of the schools of jurisprudential thought matches the U.S. system? The U.S. is mainly a natural law country. The U.S. Constitution says that all men have certain rights that are granted to them just by being born. But the U.S. has elements of all schools of jurisprudential I believe. 3) What is the common law? Common law is that body of law that developed from custom or judicial decisions in English or U.S. courts. It is not attributable to a legislature and it governs all areas not covered by statutory or administrative law. 4)
