COMMENTSDIAMONDSAREFOREVER?IMPLICATIONSOFUNITEDSTATESANTITRUSTSTATUTESONINTERNATIONALTRADEAND THEDEBEERSDIAMONDCARTELDiamondsareforever-oratleasttheyshouldbe,giventheover-inflatedpricesAmericanspayforthem.ManyAmericansholddiamondsinhighesteem,cherishingthemassymbolsofloveandaffection.Perhapsthisexplains whyAmericansarewillingtopayfarmorefordiamondsthantheyshould.Ontheotherhand, perhapsthe realreasonisthediamondcartelandtheinabilityoftheUnitedStatesGovernment toapplytheantitrustlawsfortheprotectionofthe American publicastheywereoriginallyintended.Americanstypicallyenduppurchasingadiamondthattheymistakenlybelievehashigh extrinsicvalue, andforotherreasons that cannotberationallyexplained.The Americanpeople soughttopreventthese typesofsituations from occurringalmostahundredyearsagowhenthey enactedthefirstantitruststatute.'Now,theaveragelaypersonmaynot even knowthelegaldefinitionof"antitrust,"whichvery likely onlyelicits the notionthatthegovernment "protects"consumersbyrestrictingmonopolies.2Nodoubtpeoplewouldbesurprisedtodiscoverthattheyare payinginflatedpricesbecausethe UnitedStatesGovernment has beenunabletoenforcethespiritoftheantitrustlawsagainstthelarge,powerfulinternational diamond cartel.Indeed,the businessofimportingandsellingdiamondsinthe UnitedStatesisbutone exampleofthefailureofUnitedStatesantitrustlawsagainstinternationalcartels.The UnitedStateswillbecomemoredependant on internationaltradeforitseconomicgrowthandsurvivalastheglobaleconomybecomesmorepervasive.3Thattrademustbefair,notonlytoforeigncountries, butalsototheUnitedStates.Bystudying andunderstandingthelackofcontrolUnitedStatesantitruststatuteshaveon the diamondindustry,theUnitedStates willbeinabetter positiontosolve not onlythediamondproblem,butalso theproblemofothermonopolisticindustries.1.SeeW.W.THORNTON,ATREATISEONCOMBINATIONSINRESTRAINTOFTRADE§7,at10(2ded.1928).2.Amonopolyis"[a]privilege or peculiar advantage vestedinoneormorepersonsorcompanies, consistinginthe exclusiveright(or power)to carry onaparticularbusinessor trade,manufactureaparticulararticle,orcontrolthesaleofthewholesupplyofaparticularcommodity."BLACK'SLAWDICTIONARY1007(6thed.1990).Twoormoremonopolisticproducersactinginconcertcompriseacartel,i.e."[a]combinationofproducersofanyproductjoinedtogethertocontrolitsproduction,sale, andprice,soastoobtaina monopolyandrestrictcompetitioninanyparticularindustryorcommodity."Id.at215(6thed.1990).
