The issue is that the Court appointed Posner from the Chicago school (read less stringent on antitrust) as mediator in hopes to hash out a deal instead of continued litigation at great cost to Microsoft. The anti- trust laws are in favor of the government’s ideal of a competitive marketplace, and Microsoft’s defense has shot itself in the foot in the past. If there is ever the possibility of meeting common ground rather than splitting the company into pieces because of antitrust violations, then this is it. 2. What are the author’s main reasons and conclusion? The author’s conclusion is that this mediation’s result is vital to preventing Microsoft from being brought to court by “class-action tort parasites”. If the two can strike a deal, then negative publicity against Microsoft will be limited and future anti-trust precedents will be avoided. These not only help Microsoft,
