Week 2: Case Study Assignment Darwin Quintuna 1. The Employee Polygraph Protection Act prohibits most private employers from using lie detector test either for pre-employment screening or during the course of employment. Tony’s suggestion to do a polygraph on all the employees in the warehouse is illegal. The Polygraph Protection Act of 1988 prohibits employers with a theft in the organization from testing all employees in order to determine who is guilty. But, if an investigation leads to a particular employee, then the employer can ask that employee to submit a polygraph test. This is a positive factor contributing to having a polygraph test. If the outcome of the test determines the employee is lying, then termination of employment and depending on the situation legal matters will take place. But, in such situation the employee also has the right to refuse to take a polygraph test without any worries of any retaliation from the employer. If the employee agrees to the test, he/she must receive in advance a list of questions that will be asked. This is a downside because the employee already knows what the organization is looking for. Another downside of a polygraph test is that it requires a suspect who is cooperative, feels guilty or anxious about lying and hasn't been educated to the various countermeasures that can thwart the results.
