Introduction It is safe to say that we all have had a bad day or two, for Patty the entire week was off. In this scenario, a regular day turned out to be one of the most horrible weeks ever. Patty was out looking for a new laptop at her favorite place. While shopping she remembered that she had a prior appointment and needed to leave the store in a hurry. When she tried to leave she was accused of stealing and was detained by the store security. After they determined she was not guilty of theft she left the store and was hit with a golf ball knocking her unconscious. This left her unable to work for approximately five days. Once she was fully recovered Patty was able to return to work and ran into some more issues. Although it is against company policy she decided to use her company email for personal use. When Patty was approached about the misuse of her company email, she decides to say unprofessional things about her boss online. When the comments were seen by Patty's supervisor it caused her to lose her position. Patty started as a victim of tort claims and then found herself on the opposite side of the claims. What is the possible tort claims that Patty can make against Cash Mart? Discuss the elements of the claim and how those elements relate to the facts in the scenario. A tort is a common law in which some form of negligence was performed. In the case of Patty, she was the unfortunate victim of several torts. The types of tort that Patty was a victim of were emotional distress, false imprisonment, and defamation of character. When the security guard decided to prevent Patty from leaving the store he had falsely imprisoned her. Before holding her in the store the security guard had the burden of proving he had probable cause to hold her and threaten to call the police. To prove she had stolen anything he would have to see it with his own eyes. If he had seen it then he would have pinpointed the item or at least saw where she supposedly had put the item she was being accused of stealing.
