Axia College Material Appendix C Rights and Responsibilities of Educators and Students Perform a search in the University Library databases and locate four school-related court cases (with outcomes decided), two which involve educators as defendants and two which involve students as defendants. Name and Date of Case Brief Overview of Case and Outcome Your Informed Opinion Case 1: Educator as Defendant Name of Case : Schaffer v. Weast Approximate Date(s) : November,2005 This case was established by the parents of a special needs child. There claim was that the public school did not meet the requirements that their child needed and therefore wanted the public school to pay for their child’s private school education and that the burden of proof fell upon the school. The outcome was for the school after several different ruling the final was that the burden fell upon whoever initiated the claim. In this case that is the parents of Brian Schaffer My informed opinion on this case is that I disagree with the court. If the school does not provide the needs of the child to succeed, then they should comply with IEP and establish such needs for the child or under the IDEA they should provide funding for the child in a private school. The child has the right to a free public education appropriate for the child disability needs. That to me is the only burden of proof that the child’s parents need. The school cannot provide the appropriate free education for the student. Here in the state of Florida they have a
