LEXIS 635 March 15, 2004, Decided March 15, 2004, Filed Facts Plaintiffs, a woman and a man who alleged they were engaged to be married, sued defendant dog owners claiming a violation of Conn. Gen. Stat. ß 22-357, negligence, and bystander emotional distress (BED) arising from an incident between the woman and the dog. The woman made the ß 22-357 and negligence claims. The man made the BED claim. The owners moved to strike the BED claim. The woman was attacked by one of the owners' dogs as the woman and the man were riding their bicycles. The owners had not restrained that dog. The dog ran after the woman, struck her bicycle, and caused her to fall off the bicycle and sustain various injuries. The man alleged that he suffered emotional distress as a result of witnessing the attack that went beyond what would be anticipated by a disinterested
