“Problem” Areas: Nonconfidential Information o Journalists are quite investigative, what stops courts from using them in other capacities with the knowledge they gather that isn’t promised as confidential. Waiver of Privilege o If you reveal the identity to even one other person (a third party) then you are forced to testify that information in court because in essence you already have broken the confidentiality. Confidentiality Promises: What if a journalist goes back on their promise of confidentiality? Cohen vs. Cowles Media (1991) o Minnesota Lt. Governors Race – PR person was outed for helping out the other side, and it damaged his career and character. Promissory Estoppel o If I promise you something to get you to do something, and you make that decision based on this promise to do it and I go back on my word and you suffer from harm you can sue me.
