Review Mid Term CH10 Contract – promise or a set of promises for the breach of which the law gives a remedy or the performance of which the law in some way recognizes as a duty. Elements of a Contract 1. Agreement 2. Consideration 3. Contractual capacity 4. Legality CH8 Intellectual Property (IP) – the products that result from intellectual, creative processes Patent – A grant from the government that gives an inventor the right to exclude others form making, using, and selling an invention. Trademark – distinctive mark, motto, device, or implement that a manufacturer stamps, prints, or otherwise affixes to the goods it produces so that they can be identified on the market and their origin made known. Copy rights – the right of an author or originator of a literary or artistic work, or other production that falls within a specified category, to have the exclusive use of that work for a given period of time. Trade secret – any information that a business possesses and that gives the business an advantage over competitors Source of Law
