Law as a Living Body 3 The theory and reality of law as a living body is one that many do not understand unless they have taken courses to help them. However, for most suspects that are average people do not understand. Then they seem to take a stance against the way the justice systems works. In this essay I will help normal people try and understand law as a living body, due process and the rights of the accused. Law as a living body on its own is hard to understand. However, if broken down into law on the books versus laws in action, objectivity of law, and then law as a living body one might understand it a little better. So with this I will begin with law on the books versus laws in action. The difference between law on the books and law in action is really where it is used. Law on the books in the court room means that is the law and the prosecuting attorney will try and get you prosecuted to the full extent of the law. With this the judge will decide if you are guilty or innocent. However, a law in action is more what the police will use to interpret whether or not to pull you over and arrest you. It is subject to the police officers point of view on if you was or was not breaking the law intentionally. This difference is not truly fair to the public or in the justice
