Real 300 9/13/2010 Restrictive covenants…cont Another form of non-possessory property right (non-estate). They are private rights, I take some of your bundle of rights to restrict what you can do on the property and I set them aside in this private covenant. Private restrictions (negative) and obligations (affirmative Common restrictions: o Architectural standards (setback lines, height restrictions, materials, colors, etc) o Minimum finished sq. ft o No detached structures o No RBs or boats outside of garage o Limitations on external antenna/satellite dishes o Limitations regarding pets and other animals More…. Two methods if creation o Restriction in a deed conveying a single parcel of land to a new owner (deed restriction) E.g. no alcohol C.c. fee simple condition o Restrictions imposed on an entire subdivision, consominium community, etc at its creation by a separate recorded instrument (e.g. declation of HOAs (Home owners associations) usually have these covenant declarations.
