Essay #1 A contract is a “promise or a set of promises for the breach of which the law gives a remedy, or the performance of which the law in some way recognizes as a duty.” Great Beverages Company [GBC] and Have –a- Java, Inc [HJI] have an enforceable contract. The reason why? Is because of the fact that in this type of cases the contract doesn’t take place when they are negotiating or when GBC sent HJI an email but it start when the contract is perform this is call an unilateral contract. The GBC initiated the contract meaning that they agree to sale. As for HJI they have to close the contract by doing their part of the performance and paying for the Jamaican coffee beans. This type of contract is enforced by the common law.
