Like a boxing match and a referee. Truth achieved not by adversarial nature, but by negotiation. Plea v. trial The system is adversarial Structured to be adversarial Viewed as a competition Present opposing views of the truth Every stage is a great battle. Do whatever it takes to win. Testily-bits and pieces of the truth, it depends on what you emphasize, and what you choose to leave out. You say things like I don’t recall. The Court Process The system is not adversarial. Cooperation, not competition.
