LECTURE, FEB. 19, 2010 Syllabus: NEXT FRIDAY-NO CLASS, but @ 7pm. Roe v. Wade Privacy: linchpin on sealing the notion, that there is a fundamental right to privacy that’s possessed by individual. Court: right of the individual. Bridge of fundamental right of privacy shared by married couples to the Court saying, you don’t get privacy right by getting married, but as an individual you possess this right; therefore, single people should also have this right to privacy. Dissent of Griswold: judicial activism, for inventing this right to privacy judicial activism extends to Roe v. Wade It’s not about abortion or sodomy; it’s about the zone of privacy of individual rights where you can do things as individuals. Privacy is protected-no one can is supposed to get your medical records.
