The Country of Kabaweg has a population of approximately 60 million people involving two ethnic groups, each of which are divided along religious lines that are largerly regionally separated. Out of the 60 million people in Kabaweg the literacy rate only consists of 40% of that. Kabaweg’s economy and infrastructure is in total disrepair and decay, everything has been destroyed and needs to be rebuilt, their workforce is a mix of skilled and unskilled workers however there is still a large amount of valuable natural resources within the countries borders. The country has been going through 30 years of an oppressive government that dominated all the wealth, universities, governmental beaurocracies, private companies, and controlled 80% of the countries land prior to the ratification Kabawegs Way at the constitutional convention. Under the Constitutional Convention Kabaweg approach was to reconcile the discriminatory past by demonstrating to international vestors that a peaceful revolution is possible in order to ensure their economic fate. The drafters of the constitutional convention had to follow the guidelines that required a voting procedure that would result from a simple majority of one more than 50%. The policy toward referendum insisted either a popular referendum or a regional or state legislature. With the consideration of the consensus and majoritarian model it was by their decision to either institute a Presidential or non-presidential system in order to effectively govern the torn country. There were two main concerns in order to establish an effective Democratic regime. The first was to be able to create a legitimate regime that was perceived by the diverse elements of society. If the perception failed to represent a large majority to be legitimate the country would run the risk toward grounds of dissent, unrest, and potentially civil war. Secondly the drafters must consider a healthy balance of legitimacy as well as creating the most effective governance. The new political regime must be able to balance the highly divided society and additionally needs the new regime to be one that can potentially make difficult and controversial

political decisions in order to distribute the scarce resources. Through its ratification the drafters had to weigh the pros and cons of establishing and constructing its electoral system, unicameral or bicameral legislature, judicial review or not, and federalism. Its construction and implementation had to be one that is perceived as fair and legitimate by the diverse elements of Kabaweg’s society furthermore will also be effective enough to ensure that the society will not lose its confidence that its new governing institutions will deliver an effective governance especially over time. In order to ensure that these guidelines were presented to its maximum potential the analysis of Kabaweg Way must cover four areas.
