Lynnette Castro March 7, 2008 Indv. 102 Response Paper#1 In Marci Hamilton’s article “God vs. the gavel; religion and the rule of law” the author argues that religion should not influence the decision of state legislators regarding same-sex marriage. Marci Hamilton discusses that same-sex marriages should be decided by the state legislator and that religious organizations should not be able to use religious persuasion to influence their decision making. Before same-sex marriage became controversial, marriage had always been a civil matter. In “God vs. the gavel, religion and the rule of law” Marci Hamilton discusses how the state and the states elected officials should be the predecessors determining whether same-sex marriages are in the common interest of serving the public good or creating harm. Since the same-sex marriage debate began religious organizations continue to use their organizations as political muscle in influencing states and the federal government to propose a ban on same-sex marriages.
