April 22, 2020 CLU3M1-02 1. Which of morals, ethics or manners influence the definition of law? Manners influence the definition of law because manners refer to social rules that everybody follows in order to maintain civil discourse, similar to the law, which is a set of rules that are required in society so that we do not hurt one another. 2. What is more critical to the conditions of a criminal offence: Actus Reus or Mens Rea? Mens Rea is more critical to a criminal offence because it is the intent to harm or commit an illegal act. There can be instances where someone has committed a crime (Actus Reus) but it was accidental or illegal, in which case the charges can be dropped or the sentence can be lighter unless it is proven otherwise. 3. Based on the information of the jealous wife, what offence should she be charged with? The wife should be charged with second degree murder. If B’s death was not intentional and she did not want to harm B, she could have been charged with manslaughter, and since her actions were not planned completely, it’s not considered first degree murder.
