Zippo Manufacturing Company v. Zippo Dot Com I. The Facts: Plaintiff Zippo Manufacturing Company (“Manufacturing”) is a Pennsylvania-based company that makes ‘Zippo’ brand pocket lighters. Zippo Dot Com (“Dot Com”), was a California-based corporation that operated an internet web site that offered online services with t he registered domain names “zippo.com,” “zippo.net” and “zipponews.com.” Dot Com conducted online business with 140,000 paying subscribers; two percent or 3,000 of whom were Pennsylvanians. While Dot Com conducted business with Pennsylvanians, it did not maintain any offices, employees, or agents in the state. Any visitor to the site could receive the online services by subscribing and filling out an application. Dot Com took part in agreements with internet service providers in Pennsylvania to allow residents of the state to access the content. Manufacturing filed a court complaint against Dot Com for alleging ‘trademark dilution, infringement, and false designation under the Lanham Act and state law trademark dilution
