2 Learning Team ADR Clause According to businessdictionary.com (2010), alternative dispute resolution (ADR) is defined as a type of dispute resolution that seeks to limit the costs of litigation by using alternative, often out-of-court means, such as arbitration, conciliation, and summary possession proceedings. An ADR clause will be used by the learning team to resolve disagreements among learning team members. The ADR process in which disagreements will be resolved is mediation. According to Chessman (2010, p. 45), mediation is defined as a form of negotiation in which a neutral third party assists the disputing parties in reaching a settlement of their dispute. This person is known as a mediator. Disagreements without a resolution within 24 hours will initiate the ADR process. The nature of the disagreement must be on a professional level and in regard to rules and regulations not followed by team members. Mediation Process
