An easement appurtenant arises when the owner of one piece of land has a right to go onto an adjacent piece of land owned by another. I think that Lee can use the right-of-way across Kay’s property. When a parcel of land that is benefited by an easement or profit appurtenant is sold the property carries the easement or profit along with it. Thus, if John sells the orchard to Lee, John also conveys the easement to Lee. Question 2 Mike owns an office building in fee simple, which he is entitled to use, possess, and dispose of the property as he chooses during his lifetime.
