Definition of Criminal Punishment Action taken against a person who has been found guilty or plead guilty of engaging in criminal acts. It involves the infliction of pain or at least a negative consequence. Its major purpose is to prevent future crime or inflict a deserved pain on the offender, not to compensate the victim or to better the offender's condition. 01/30/11 Corrections 3

Criminal Punishment (1) Person punished must be responsible for the criminal behavior; (2) Punishment is intended to be painful; (3) Punishment follows the official condemnation of the act (i.e., the action of the state follows the determination of guilt); (4) Punishment is imposed only by those who have the legal authority to do so; (5) Both the behavior that is to be punished & the punishment must be specified in advance. 01/30/11
