4 Problems With 3 Elements: Lack of certainty:   12 million serious crimes (murder, rape, robbery,  assault) are reported every year.  Only 1.7 million people are arrested for these  crimes.  1.1 million are charged with those crimes.  Only 300,000 of those charged receive jail time.  Our current criminal justice system does  not   ensure punishment for crime.

5 Problems Lack of swiftness:   Time works in favor of the defendant.  Long delays between crime and punishment: 1. separate the punishment from the crime in the mind of  the felon  2. only give the defendant more chance of going free.
