Premises Liability What can our customers/guests expect from us as venue or event managers? Premises liability is the legal responsibility a venue or event manager owes to the individuals utilizing the venue.

Negligence Negligence is defined as an unintentional act that injures. Negligence liability is the basis for more lawsuits in our industry than any other area. Negligence can be based on something a defendant did or did not do that results in the plaintiff being injured.

Elements Necessary For Negligence Duty Breach of Duty Proximate Cause Damages All four of these elements must exist for a finding of negligence.

Duty There are three criteria necessary for duty to exist. There must be a “relationship” that requires the service provider to protect the plaintiff from unreasonable risk of harm. The relationship must involve “types of specific duties”. (industry standards) The plaintiff must have a certain “status”.
