I have concluded the following: a) The applicable statutes begin in the Texas Education Code Title 2(f) Chapter 29(a) and  include 20 U.S.C. Section 1400 b) A student is eligible for special needs education if the student is:    (1)  is not more than 21 years of age and has a visual or auditory  impairment that prevents the student from being adequately or safely  educated in public school without the provision of special services; or
