February 16, 2010 Indivudals not applicable to international law until recently Post second world war there was a shift Individuals now hae rights and obligations Individual now has legal personality Can an individual sue and be sued under international law Individuals have to go through their own government to sue another country, they can’t individually do it Jones is entitled to sovereign immunity One state or its representatives cannot be sued in a court of another country Individuals cannot pursue states in an international court, only states can do this Not the world court, however the international ciriminal court would be able to hear a case where the person violated international law. Soldier jones can be held accountable underinternational law Individuals can be held accountable under international law From soldier jones hypothetical take this away: Under international law, the individual can be sued as a defendant. However the individual cannot act as a plaintiff.
