Legal Assistance for Seniors Financial Abuse A. Definition of Financial Abuse: 1. Any theft or misuse of an elder's money or property, by a person in a position of trust with an elder. This includes unethically exploiting the elder by using assets for the abuser's gain. B. Indicators of Financial Abuse (Providing clues, but not conclusive evidence of abuse) 1. Checks signed in handwriting not resembling the older person's or signed when 2. the older person cannot write. 3. Power of attorney given when the person is incapable of making such decisions. 4. Recent/new power of attorney executed. 5. New acquaintances expressing affections for a dependent elder with assets. 6. Missing personal belongings such as art, silverware, or jewelry. 7. Deliberate isolation of an older adult by a housekeeper or caregiver from friends 8. and family. 9. Mail is missing or being intercepted. 10. Unusual or inappropriate activity in bank accounts. 11.
