Illegal. Disparate impact is an unintentional disparity between the proportion of  a protected group applying for a position and the proportion getting the job.  Because the height restriction has to relate to being able to perform the  actually job itself. Will it be hard to perform the job at taller heights? According  to the “Supreme Court decision: Griggs VS. Duke Power,” ruled that job  requirements must be related to job success.
