Marko Urlic 11 -19 -2010 Essay #17 Constitutional issue raised in Adarand litigation was that preferential treatment for minority and female constructors was unconstitutional. In 1987 Congress appropriated $16 billion to the Department of Transportation (DOT) for highway construction across the nation. Ten percent was earmarked for small businesses run by “social and economically disadvantaged individuals. The first one, social, were defined as “those who have been subjected to racial or ethnic prejudice or cultural bias”, while the second one, economically disadvantaged individuals, were defined as “those whose ability to compete in the free enterprise system has been impaired due to diminished capital and credit opportunities as compared to others in the same business area where are not socially disadvantaged.” It was to be presumed that black, Hispanic, Asian Pacific, subcontinent Asian, and Native American person and women were both socially and economically handicapped.
