Facts of the Case Note: Although this Mock Trial is based upon an actual case, some of the facts have been changed or assumed to simplify for the purposes of the Mock Trial. All facts stated in the Complaint may be taken as true. Ricardo Loya was a 26-year old resident of Sammamish, Washington, on May 26, 2005, when the accident happened. Ricardo was staying at the time-share condo on the same grounds as the Westin Regina Golf Beach and Spa Resort in Cabo San Lucas, Mexico. Ricardo was with his wife and two friends on vacation. They had traded for their time-share condo in Colorado. The website of the Westin states that scuba diving is available near the hotel and that dive equipment may be rented at the dive shop on the hotel premises. The scuba diving trips were also stated in the hotel’s printed brochures in the hotel room and on a list of “Things to do” in the hotel lobby.
