STATE OF IDAHO V. SHARON K. ELDRED 2 Abstract A fundamental right of all citizens is the right of a fair trial. When a citizen commits a crime, is arrested and, by due process, is found guilty that citizen may still have the right to appeal to a higher court to over-turn the ruling. Although no new evidence may be admitted, this gives the appellant (the losing party) the chance to cite precedents (previous court decisions) related to the facts of case (The Free Dictionary By Farlex, 2009). Here we will review a summary of the case, how the criminal justice process worked, the interactions that occurred, and the outcome of the case.

Eldred was followed on the highway by a concerned citizen after he witnessed Eldred drive erratically across traffic. Eldred was confronted by another individual when she stopped in a parking lot after which she sped off and ran over a flower bed. When she arrived home a police officer asked her to stop but Eldred ignored the officer. The officer went into her home and notice obvious signs of intoxication. The officer then administered field sobriety tests, but Eldred was noncompliant and combative. The officer arrested Eldred under suspicion of
