In May of 2000, a 30 year old mother-to-be in her 28 th week of gestation went to a Brooklyn, NY hospital complaining of abdominal pain. After giving birth one hour later to a premature and underweight baby. All tests were preformed minus the blood gas test. After 28 hours the hospital finally performed the blood gas test and realized that the infant’s pH level was 7.254, an indication of metabolic acidosis (acidic blood). Doctors then began treatment. Doctors did not check the blood gases for 9 more hours following treatment and the infant’s pH continued to fall. By May 31 st the infant developed a hemorrhage and was transferred to another Brooklyn, NY hospital were he would remain for four months before being diagnosed with sever brain damage and cerebral palsy. In a court of law a jury awarded the infant
