Fidati 1 Hannah Fidati Ms. Jennifer Basye English 1102 11 October 2010 Argumentative Analysis In Michael Smerconish’s editorial, Free (and hateful speech) vs. the right to gather, the Philadelphia Inquirer columnist delves into the right of free speech at funeral processions in the case Snyder vs. Phelps. Smerconish argues that, “Just as it is illegal to yell, ‘Fire,’ in a public theater it should also be illegal to yell, ‘Fag,’ at a fallen soldier’s funeral procession” (Smerconish 1). The Westboro Baptist Church started causing controversy after their congregation began protesting perverse messages at fallen soldier’s funeral processions. Such messages included, “God hates FAGS,” “Thank God for IED’s,” and “Thank GOD for Dead Soldiers.” Smerconish introduces the argument at hand by analyzing the right to freedom of speech versus the right to gather at a public funeral. Smerconish also tests the judicial reasoning in the Supreme Court’s decision to withhold charges against the Westboro church. Smerconish elaborates his argument through ethos providing key judicial documents, interviews with multiple inside sources, and logical reasoning to provide support for his claim. The fresh logic used in Smerconish’s article helps the audience to decipher whether or not the Westboro Baptist Church displays a right to free speech or instead is encroaching upon a family’s right to gather peaceably at a public funeral.
