HIGH LEVEL PANEL DIALOGUE ON THE POST CONFLICT CRISIS IN COTE D’IVOIRE. INTRODUCTION. Ladies and gentlemen, thank you very much for offering us this important platform to shade light on the crisis unfolding in Cote d’Ivoire Coast following the 28 November 2010 Presidential election. Before proceeding, I would like to put forward the following: Mr. Alassane Ouattara is the elected President of the Republic of Cote d’Ivoire. He is recognised by the majority of the Ivorian, the ECOWAS, the AU, the UN and the rest of the international community. There is no absolute doubt about this. I. The contentious issues pertaining to the election. (table of the results of the election) 1. The validity of the results announced by the IEC a. Timeframe. Art.38 and 59 of the electoral code indicate that the IEC is competent to announce the provisional results of the presidential elections. This is not contested by any of the parties. The contentious issue is the time-frame and the place of the announcement of the results. It is important to underline that the time frame of 3 days within which the results of the election should be announced is not indicated in the electoral code. What is stated under Art.59 is that “the electoral commission notifies the CC a copy of the minutes and supporting documents within 3 days after the election”. Even here there is a precedence as the results of the 1 st round of the elections were announced in the 4 th days in the early morning. No one contested that. There is deliberate attempt of lies in the document provided by the LMP –mention of the Ministry of Interior. There is a deliberate attempt to mislead the opinion). 1

b. The place of the announcement of the results. We would like to put to the attention of the public that the President of the Electoral Commission could not announce the results at the IEC headquarters as it was transformed into a military camp. The Republican Guards led by a certain Capt.Ble along with militia men loyal to Mr Gbagbo invaded the IEC Hqs and requested the national TV to dismantle its installation and expels all national and international media waiting for the announcement of the results.
