LECTURE #3: Legal Issues To prove liable or negligent - must find four things: o Legal duty of care to conform to certain standards o Breach of duty: if standards are not met o Breach is proximate cause of injury o Harm was direct cause of breach of duty Protect Yourself - Establish a plan that works for you in your setting and follow it - Know how to act on what you know - Watch what you say (confidentiality) Standard of Care - What another minimally competent individual, educated and practicing in that profession, would have done in the same or similar circumstances to protect an individual from harm Tort - a civil wrong (other than breach of contract), in which a court will provide a remedy in the form of damages suffered - Malfeasance o Individual commits an act that is not his / her responsibility - Misfeasance o Individual commits an act that his / her responsibility but uses the wrong procedure, or does correct procedure in the wrong way - Nonfeasance o Individual fails to perform his/her legal duty of care
