H N N l q L Ethics Texas lawyers has rejected a rule to ban lawyers having sex with their clients unless they were married or were in a relationship. Rule was rejected by 72% of lawyers in Texas. Assault and Battery Transfer of intent -Try to shoot someone, person ducks, hits another guy -> intent transferred Imminent unwanted touching – assault at the moment of imminent contact. o Threat of future or distant harm is insufficient Another qualifier – plaintiff has to be aware of the intent Plaintiff’s fear must be reasonable Battery – offensive and unwanted contact; doesn’t have to involve any physical injury although if there is any, you will probably be awarded more. o Intention need not be malicious nor an intent to cause actual damage, sufficient if the person intend to make harmful contact. Defenses to assault and battery Typically 2 year window to sue Consent/ Rules of the game – eg. When you play football, you consent to get a level
