Civil Procedure 11/20/08 Ethical Limitations in Pleading Christian v. Mattell, Inc., 9 th Circuit, 2003 Facts : Christian said Mattell copied a doll she copyrighted in 1996. Mattell showed Christian’s attorney that the doll had a copyright of 1991 on the back of its head. Procedure : district court ordered Christian’s attorney to pay Mattell $500,000 in attorney’s fees that it incurred in defending a frivolous lawsuit.
