Sociology of the Criminal Justice System – 2/08/11 Chapter 3: Defining and Measuring Crime Classifying/Defining Crime Three important classifications of crimes include: o (1) Criminal vs. Civil o (2) Felonies vs. Misdemeanors o (3) Mala in Se vs. Mala Prohibita Criminal Law o Concerned with protecting society from harm o The remedy for violations is some form of punishment Civil Law o All other law o Concerned with disputes between private individuals and between entities o The remedy for violations of civil law is compensation Guilt and Responsibility o Criminal court is concerned with guilt o Civil court is concerned with responsibility Burden of proof o The burden of proof is beyond a reasonable doubt (in a criminal court) o The burden of proof is preponderance of the evidence (in a civil court) Felonies o More serious or atrocious than misdemeanors

Punishable by death or imprisonment in a penitentiary for a period of a year or longer o Range from capital offenses to third degree felonies o Degrees of murder First degree: crime has to be premeditated and deliberate Second degree: no premeditation or deliberation but malice of forethought (acted in disregard of the consequences of actions) Homicide (manslaughter) Voluntary manslaughter—intent to kill present but malice lacking Involuntary manslaughter—actions are careless but no intent to kill Misdemeanor o Less serious crimes o Punishable by a fine and or incarceration in a local jail for up to one year o Degrees of misdemeanors Gross misdemeanors Petty misdemeanors Infractions **Mala in Se o Acts that are inherently wrong, regardless of whether they are prohibited by law o “Natural laws” – go against the morals of society
