Managing Regulations and Torts 2 Managing Regulations and Torts Businesses may find it difficult these days to be governed by strict rules and regulations and yet stay successful in this competitive market. Managers in a successful company such as Alumina, will have to manage risk effectively and develop better practices to limit tort liabilities. Poor management decision of risks can have a negative effect on the company, which in turn can affect the company’s public reputation and potential revenue. A method of limiting the exposure to risk is anticipating changes in regulations and establishes methods of incorporating the changes in their policy and procedures. This plan will discuss various ways for companies to prevent, detect, and correct risks and torts. The company in the Business Regulation Simulation, Alumina, was found guilty of the tort of negligence and resulted in strict liability five years ago. During a routine audit, Environmental Protection Agency (EPA) found a breach of duty reporting that the polynuclear aromatic hydrocarbon (PAH) levels exceeded the standard of emission for the company. Alumina swiftly corrected the non-compliance and continually maintained their levels of PAH below the maximum emissions level. Bates, a local citizen, accused Alumina of “repeatedly contaminating the waters of Lake Dira” which caused her
