L293 (4/27/2009) Employment Discrimination  Sex Discrimination o Refers to gender-based discrimination only (for now) o Forbids discrimination against both women  and  men o Forbids sexual stereotyping Sexual Harassment o Two major categories of sexual harassment are prohibited by Title VII: Quid pro quo  (this for that):  when an aspect of a job is made contingent  on an employee’s sexual activity. Can only be committed by  supervisors Hostile work environment :  when sexual talk and innuendo are so  pervasive that a hostile work environment is created for the employee.  Can be inflicted by supervisors or co-workers.  Title VII and Sexual Harassment o Harassers and victims may be either gender, and  Oncale v. Sundowner  confirms  that Title VII allows recovery when the harasser(s) and harassee are same  gender o Harasser(s), individual manager(s), and the company are  all  potential defendants Employer Liability for Sexual Harassment  o Depends on whether harasser was a  co-worker  or a  supervisor Co-worker     : Employer only liable if they  knew or should have known  about the harassment Supervisor     : Employer vicariously liable whenever harassment results in  tangible employment action .  If no tangible employment action,  employer may escape liability by proving:  (1) that the employer exercised reasonable care to prevent and  promptly correct the harassment; and (2) that the plaintiff unreasonably failed to take advantage of  preventative or corrective opportunities provided by the employer. Age Discrimination o Age Discrimination in Employment Act  Prohibits age-based discrimination against employees or job applicants at  least 40 years old General Dynamics v. Cline
