Erie Analysis 20/11/2008 19:41:00 REA When FRCP Governs the Dispute   of the district courts o “the judicial process for enforcing rights and duties recognized by  substantive law and for justly administering remedy and redress”  Does it abridge, enlarge, or modify a substantive right ? o Examples: A federal rule barring tresspassers from recovering  damages would be struck down as substantive  o Provision barring enforcement of monopoly contracts would be struck  down  o A presumption  exists in favor of finding a FRCP valid  o a court can refuse to apply a FRCP o “only if the Advisory Committee, this Court, and Congress erred in their  prima facie judgment that the Rule in question transgresses neither the  terms of the Enabling Act nor constitutional restrictions” But, a court need not blind itself to the degree to which the Rule makes the
