Oral Wagers and Contracts 2 Abstract Generally, the contract is void, or the courts will leave the parties as it found them, when the goal of a contract is illegal. (Goldman, 2007) The purpose of this paper is to determine the following questions based upon the evidence presented in the case of Tommy and William who made an oral bet for one-hundred dollars on the outcome of the Super Bowl game. William wins the bet and Tommy refuses to pay the sum of one-hundred dollars to William. Question 1: Is the bet between Tommy and William legal? Question 2: Does William have grounds to file suit in small claims court to get the money owed to him by Tommy? Question 3: Is the oral contract binding and enforceable by law?

Oral Wagers and Contracts 3 “Legal issues of sports betting are difficult to generalize and tackle. There are various laws regarding gambling. Thus, rules and regulations vary from nation to nation. For one, legal articles in the United States, often state that the premiere law to be followed is the Professional and Amateur Sports Protection Act of 1994. Generally, this law stipulates that operation of gambling schemes of whatever form are illegal except for a handful states including Nevada.” (Huston, Peter, 2010)
